Barbara M. Prohaska

Ms. Prohaska joined CMV in May 2001, having practiced with a large Chicago law firm from 1993-2001. At CMV, Ms. Prohaska continues to represent health care and child care providers in professional liability and employment matters, and brings to the firm her many years of experience in representing both insured and self-insured clients in litigation and health care counseling matters, including hospitals, nursing homes, assisted living facilities, child care providers, and individual providers.

Since becoming licensed in Illinois in 1991, Ms. Prohaska has represented a wide array of insured and self-insured clients in State and Federal courts, in the areas of product liability, premises liability, municipal liability, toxic tort, medical malpractice, nursing home, assisted living, and long-term care litigation, condemnation, consumer fraud, commercial, and equitable claims. She has appeared in courts of both law and equity across northern Illinois and has obtained favorable results for her clients.  In recent years, Ms. Prohaska has devoted substantial time to defending employment-related claims against child care facilities in matters alleging negligent hiring, retention, and supervision, breach of contract and institutional negligence, where punitive damages were sought. 

In addition to her litigation practice, Ms. Prohaska has counseled clients on issues related to record subpoenas, patient confidentiality, the Mental Health Act, HIPAA, certificates of need, Medicare and Medicaid reimbursement, and fraud and abuse laws. She has substantial experience in Appellate Practice, having clerked for the Honorable Justice Robert D. McLaren of the Illinois Appellate Court for the Second District from 1991-1993.  She has briefed and argued numerous appeals in the First and Second District Appellate Courts in Illinois, including the following:
