Lang and Nankervis win defense verdict for neurosurgeons and local hospital

Tom Lang and Jeff Nankervis secured a defense verdict in favor of two defendant neurosurgeons and a local hospital following a week and a half long trial in Cook County in December 2023.  Plaintiff claimed that the defendant physicians improperly placed pedicle screws during a lumbar spinal fusion surgery, allegedly resulting in failure of the fusion, the need for a revision fusion and permanent low back pain and disability. Plaintiff further claimed that the defendants failed to order intra-operative and post operative CT imaging to verify the location/placement of the screws.  On behalf of the defendants, Tom and Jeff presented evidence to demonstrate that the screws were all placed in the proper location to give the patient the best chance for fusion and that the failed fusion was not the result of how the screws were placed or any other aspect of the defendants' conduct. Plaintiff claimed permanent pain due to placement of the screws and the failed fusion, and that he was unable to work as a result. At trial plaintiff’s counsel asked the jury to award $6.4 million in damages. The jury returned a verdict in favor of all defendants.
